TERMS & CONDITIONS
1. Definitions: "Agreement" means all terms and conditions found on this form. "You" or "your" means the renter. "We", "our" or "us" means Tessler Trailer Rentals LLC.
2. Rental, Indemnity and Warranties: This is a contract for rental of the trailer. We may repossess the trailer at your expense without notice if abandoned or used in violation of law. You agree to indemnify and hold us harmless from all claims arising out of this rental.
3. Condition and Return of Trailer: You must return the trailer to the place, date and time specified, in the same condition received except for ordinary wear.
4. Responsibility for Damage or Loss: You are responsible for all damage to or loss of the trailer, including damage caused by weather, road conditions and acts of nature, whether or not you are at fault.
5. Equipment: You acknowledge receiving all listed equipment and are responsible for returning all items in good working condition or paying replacement cost.
6. Prohibited Uses: No hazardous items, no living persons in trailer, no use under influence of drugs/alcohol, no use outside the United States, no loading beyond capacity, no illegal purposes.
7. Charges: You agree to pay all charges including time, applicable taxes, traffic/toll violations, recovery costs, and a 5% late payment fee. No refund for early return.
8. Deposit: We may use your deposit to pay any monies owed under this Agreement including our estimate of damages.
9. Modifications: No term of this Agreement can be waived or modified except by a writing that we have signed.
10. Waiver: A waiver by us of any breach is not a waiver of any additional breach. You release us from liability for consequential, special or punitive damages.
